Use of compulsory acquisition powers for Algores Way

On 16th December 2024, MVV Environment Medworth Limited served a temporary possession notice on Fenland District Council for site enabling works to be undertaken. This notice included the section of Algores Way that is not public highway. As Fenland District Council is not willing to enter into a voluntary property agreement for the ongoing use of this section of Algores Way, it has been necessary to use the compulsory acquisition powers granted by the Secretary of State in the Medworth Energy from Waste Combined Heat and Power Facility Order 2024 to permanently acquire the necessary access rights.

 

How does this affect my right to use Algores Way?

These new access rights are being taken ‘in common’ with existing access rights over this section of Algores Way. If you currently have rights of access along this section of Algores Way, your rights of access will be maintained and you will continue to be able to use this section of Algores Way.

 

What about traffic management?

There may be limited times where traffic management is needed to control how vehicles access Algores Way to keep traffic running smoothly. Any traffic management will be controlled by the Construction Traffic Management Plan. The Construction Traffic Management Plan also controls the number of vehicles that can use Algores Way whilst the works to create the new access on New Bridge Lane are being carried out. The Construction Traffic Management Plan has been approved by Cambridgeshire County Council.

 

What if you damage Algores Way?

A survey of Algores Way has been carried out before construction of the project started. We must repair any damage that we cause to Algores Way, so that it is put back to that standard. This legal commitment is contained in the Construction Traffic Management Plan.
