Fenland District Council’s application for permission to judicially review the Secretary of State’s decision to make the Medworth Energy from Waste Combined Heat and Power Facility Order 2024 has been refused by the High Court of Justice, Planning Court, on the basis that the grounds set out in the claim were not arguable with a real prospect of success. The appeal period for that decision has now expired and Fenland District Council have confirmed that they will not pursue the challenge further.
